1. Acceptance of Terms
By creating an account on PhlebotomyHub ("Platform", "we", "us", or "our"), you ("Provider", "you") agree to be bound by these Terms of Service. If you do not agree to these terms, do not create an account or use the Platform.
These terms constitute a legally binding agreement between you and PhlebotomyHub. By clicking "I agree" or creating an account, you confirm you have read, understood, and agree to these terms.
3. Independent Contractor Status
You are an independent contractor, not an employee of PhlebotomyHub. This distinction is critically important.
By using this Platform, you acknowledge and agree that:
- You are operating as a self-employed independent contractor
- PhlebotomyHub is not your employer and has no employment relationship with you
- You are solely responsible for your own taxes, insurance, and business expenses
- You are responsible for obtaining and maintaining all required licenses, certifications, and permits
- PhlebotomyHub does not control how, when, or where you provide services
- You set your own rates, hours, and service area
- You are responsible for your own professional liability insurance
- PhlebotomyHub does not guarantee any minimum number of bookings or income
4. Eligibility Requirements
To use PhlebotomyHub as a service provider, you must:
- Be at least 18 years of age
- Hold all required phlebotomy certifications and licenses required by your state or jurisdiction
- Maintain any required professional liability or malpractice insurance
- Comply with all applicable federal, state, and local laws and regulations governing the practice of phlebotomy
- Have a valid government-issued ID
- Have a valid bank account or payment processing account to receive client payments
PhlebotomyHub reserves the right to verify your credentials and to suspend or terminate your account if you do not meet these requirements.
5. Account Registration
When creating your account, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Notify us immediately of any unauthorized use of your account
- Be responsible for all activity that occurs under your account
You may not create more than one account per person or transfer your account to another person without our written consent.
6. Fees and Billing
Activation Fee
A one-time activation fee of $49 is required to activate your PhlebotomyHub account and booking page. This fee is non-refundable once your account has been activated and your booking page has been created.
Monthly Subscription
Following activation, a monthly subscription fee of $25 per month is required to maintain your active account and booking page. This fee is billed automatically on a monthly basis.
Commission
PhlebotomyHub charges zero commission on your bookings. Every dollar your clients pay goes directly to you through your own payment processor.
Cancellation
You may cancel your subscription at any time. Your account will remain active until the end of your current billing period. No refunds are issued for partial months.
Price Changes
PhlebotomyHub reserves the right to change subscription fees with 30 days written notice to your registered email address.
7. Provider Conduct
As a provider on PhlebotomyHub, you agree to:
- Provide services in a professional, safe, and competent manner
- Accurately represent your qualifications, certifications, and services
- Maintain all required professional standards and certifications
- Treat all clients with dignity, respect, and professionalism
- Follow all applicable infection control and safety protocols
- Properly handle, store, and dispose of biological specimens and materials
- Maintain appropriate professional liability insurance
- Not engage in any fraudulent, deceptive, or misleading practices
- Honor bookings made through your PhlebotomyHub booking page
- Respond to client inquiries in a timely and professional manner
Violation of these conduct standards may result in immediate account suspension or termination.
8. HIPAA and Client Privacy
You are solely responsible for your own HIPAA compliance. PhlebotomyHub is a scheduling platform and does not store protected health information (PHI) on your behalf.
As an independent phlebotomy service provider, you may be subject to HIPAA and other healthcare privacy regulations. You agree to:
- Comply with all applicable federal and state healthcare privacy laws including HIPAA
- Properly handle and protect all client health information
- Obtain all required authorizations and consents from clients before collecting specimens
- Maintain appropriate safeguards for client information in your own systems
- Not store protected health information through the PhlebotomyHub platform
PhlebotomyHub collects only the minimum information necessary to facilitate bookings and send SMS notifications. Detailed client health information should be managed through your own HIPAA-compliant systems.
9. Client Payments
PhlebotomyHub does not process client payments for your services. You are responsible for:
- Setting up and maintaining your own payment processing accounts (Square, Stripe, PayPal, Zelle, Cash App, Venmo, or other processors)
- Collecting payment from clients directly
- Setting your own service prices
- Managing your own refunds and disputes
- Reporting and paying all applicable taxes on income earned
PhlebotomyHub is not a party to any financial transactions between you and your clients.
10. Limitation of Liability
To the maximum extent permitted by applicable law:
- PhlebotomyHub is not liable for any acts, omissions, errors, or negligence of any provider
- PhlebotomyHub does not guarantee the accuracy of any provider's listed credentials or qualifications
- PhlebotomyHub is not responsible for any injury, illness, or damages resulting from services provided by any provider
- PhlebotomyHub's total liability to you shall not exceed the amount you paid in subscription fees in the three months preceding the claim
- PhlebotomyHub is not liable for any indirect, incidental, special, or consequential damages
You agree to indemnify, defend, and hold harmless PhlebotomyHub, its owners, officers, and agents from any claims, damages, or expenses arising from your use of the Platform or your provision of phlebotomy services.
11. Termination
Either party may terminate this agreement at any time:
- You may cancel your account at any time through your admin dashboard or by contacting us
- PhlebotomyHub may suspend or terminate your account immediately for violation of these Terms
- PhlebotomyHub may terminate your account with 30 days notice for any other reason
Upon termination, your booking page will be deactivated and you will no longer have access to the Platform. The activation fee is non-refundable upon termination.
12. Changes to Terms
PhlebotomyHub reserves the right to update these Terms of Service at any time. We will notify you of material changes by email to your registered address at least 30 days before the changes take effect. Your continued use of the Platform after that date constitutes acceptance of the updated terms.
